Getman Sweeney is investigating the possibility of filing a lawsuit against Central Refrigerated Services, Inc. and Central Leasing, Inc. for various aspects of its “owner operator” program. Specifically, we are investigating three claims. First, whether CRS and CLI exert so much control over drivers that they are really employees (and thus entitled to back pay for unlawful deductions such as lease, insurance, gas, tolls, maintenance, etc., and failure to pay the minimum wage). Second, whether the lease program constitutes unlawful forced labor by tying drivers to their trucks and working for Central Refrigerated under threat of debt, for a period of years. Third, whether the company misrepresented the increase in pay owner operators will receive compared to company drivers. Getman Sweeney filed a similar case against Swift Transportation.
