This case is brought by landscape workers for TruGreen to recover unpaid minimum wages plus an equal amount in liquidated damages. Plaintiffs are foreign workers brought into the U.S. by TruGreen on an H-2B visa. The complaint claims that TruGreen fails to reimburse all workers’ travel expenses to get to the job as required with the first weeks wages. The case also charges that TruGreen failed to pay return travel expenses with the last week’s pay. TruGreen claims to be the largest landscaping company in the U.S. The case is brought as a collective action for all H-2B workers throughout the country who worked in the last 3 years. It is also brought as a class action on behalf of workers in New York (for the last 6 years) and New Hampshire (in the last 3 years). The case is being co-counseled with Edward Tuddenham. It is filed in the U.S. District Court for the Western District of New York.
