Federal and state law governing minimum wages and overtime for Home Care Workers who work for agencies in private homes providing care to the disabled and the elderly have recently changed to offer more protection to workers. Since January 1, 2015, Home Care Workers who are employed by an agency to work in private homes are entitled to overtime the federal Fair Labor Standards Act and many state overtime laws (such as NY and CT overtime law). Getman, Sweeney & Dunn has handled similar litigation for workers providing in-home health care services and is currently litigating claims against Future Care, Inc., and SeniorBridge (a part of Humana at Home).
