Assistant Account Executives, Assistant Account Coordinators, and Assistant Strategists in Ad Agencies

Many advertising agencies use employees with job titles such as assistant account executive, assistant coordinator, or assistant strategist. Some of these agencies classify people in these positions as exempt from state and federal overtime requirements. As a result, assistant account executives, coordinators, or strategists work overtime without receiving overtime wages.

Even though an assistant account executive, coordinator or strategist may be paid a salary, the employees may still be entitled to overtime pay. For example, employees who earn less than $1,125 per week (annualized at $58,500) may be entitled overtime wages. In addition to the unpaid overtime wages, employees may be due liquidated or double damages, prejudgment interest, and other New York Labor Law damages.
