Companies Requiring Workers to Work Off the Clock
Getman, Sweeney & Dunn has handled numerous cases where workers are made to perform free work for the company, by working “off the clock.” This can take many forms and includes: pre-shift work such as logging in to a computer or putting on protective gear; working through lunch; post-shift work such as continuing a phone call with a customer or leaving a work station and taking off protective gear; or even performing work at home; or completing trainings. In these cases, the lack of time records for the work does not prevent the claim from being brought successfully, as workers are permitted simply to testify about the full extent of the unpaid hours. The employer’s failure to pay for off the clock work can result in wage violations.
