Fighting for Fair Pay

Ad Agency Employees and Overtime Laws

In the advertising industry, heavy workloads and tight deadlines are a part of agency life, which means long hours and irregular schedules are all too common.

Many advertising agencies use job titles such as Assistant Account Executive, Assistant Coordinator, or Assistant Strategist. Some of these agencies classify these positions as exempt from state and federal overtime requirements. As a result, hard-working employees are putting in long hours without getting paid overtime.

Depending on your job duties, even if you are paid a salary, you may be entitled to overtime pay if you earn less than $844 per week ($43,888 per year) and worked over 40 hours in any week.

In addition to unpaid overtime wages, your employer may also owe you interest and New York Labor Law damages. For more information, you can also read about New York State Department of Labor’s overtime FAQ.

Use our Overtime Questionnaire and Overtime Calculator to find out how much overtime pay you may be entitled to.

Contact us if you have worked in an assistant position at an advertising agency and were not paid an overtime premium for hours worked over forty in a week. We can help you understand your rights. The call is free and confidential.
