Many companies operate call centers for customer service and/or sales. Help desks are another form of call center. The entitlement to overtime in these positions is usually very clear. The fact that workers are paid a salary does not alter the company’s obligation to pay overtime for hours over forty. Frequently call center employers require employees to do work that is outside their scheduled shift speaking on the phone, such as logging in or out, booting up, taking trainings, following emails or help tickets, etc. Unfortunately, these practices continue to plague the industry. Getman, Sweeney & Dunn has successfully sued call centers for their failure to pay overtime at the rate of time and one half for all hours over 40.
